THIS IS A LEGAL
AGREEMENT BETWEEN YOU AND SIMPLY PHOTOGRAPHY. BY
PURCHASING ANY IMAGE FROM THIS WEBSITE OR PURCHASING ANY
PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS
AGREEMENT. IF YOU ARE PURCHASING THE IMAGE(S) ON BEHALF
OF AN EMPLOYER THAN THIS AGREEMENT HEREIN APPLIES TO
YOUR EMPLOYER AS WELL AS TO YOU, AS A REPRESENTATIVE OF
YOUR EMPLOYER. IF YOU SHOULD DISCONTINUE YOUR
EMPLOYMENT, THEN YOUR EMPLOYER MAY CONTINUE TO OPERATE
UNDER THIS AGREEMENT. ALL IMAGES INCLUDED IN THIS
WEBSITE ARE COPYRIGHTED AND OWNED BY Simply Photography
Inc. ALL RIGHTS SPECIFICALLY GRANTED TO YOU BY THIS
AGREEMENT ARE RESERVED. YOUR RIGHTS TO THE IMAGES ARE
SUBJECT TO FULL PAYMENT OF THE LICENSE AND ARE SET FORTH
IN THIS AGREEMENT. |

Returns
Unused and unopened goods only may
be returned within 15 days from the original invoice date for a
refund. A return authorization number is required for all
returns. A 15% restocking fee will apply. Buyer must prepay
return freight. Custom made and other special order items are
not returnable.
Prices
Prices on acknowledged orders are
firm. Prices listed in any catalog or price list are subject to

Grant of License
Simply Photography Inc. grants to you and your employer,
if you are purchasing on behalf of your employer, a
non-exclusive and non-transferable right to use images
purchased from this web site. The images are non
sub-licensable and may not be incorporated into a
product for the purpose of redistributing, sublicensing
or reselling the images. The images may not be rented,
downloaded or transferred electronically in a form
designed or intended for permanent storage or re-use
such as an electronic network or bulletin board. The
image may NOT be stored on a computer or on disc for
purposes of creating an image library. Use of an image
in a manner not specifically authorized by Simply
Photography and set forth in this agreement shall be
construed as infringement and a breach of this
agreement.

Delivery Charges
All costs of freight,
transportation, mailing and insurance, unless prepaid and all
demurrage charges shall be paid for by Buyer. Buyer shall also
pay for all increased freight rates whether prepayment for
freight rates has been made or not. .
Delivery
Delivery of the goods by Seller to
the carrier at the point of origin shall constitute delivery of
the goods to Buyer and thereafter the shipment of goods shall be
at the Buyer’s risk. All claims and allowances for damage to the
merchandise incurred in transit must be filed against and
presented immediately to the carrier by the Buyer.
